The FTC Funeral Rule: Your Rights When Buying a Casket

The federal rule that gives families the right to buy a casket from any provider and have it accepted by any funeral home — explained plainly.

What the FTC Funeral Rule actually says

The FTC Funeral Rule (16 CFR Part 453) requires every funeral provider in the US to let you buy a casket from any source and to accept it without charging a handling fee. This has been federal law since 1984 and was reaffirmed in 1994.

Why funeral homes mark up caskets 300-500%

Caskets historically carry the highest margin at a traditional funeral home. A casket that wholesales for $900 is routinely sold for $3,500-$4,500. Buying direct — with delivery to the funeral home — typically saves families $2,000-$4,000 per service.

How to assert your right

You do not need permission. Simply tell the funeral home which casket you have ordered, from whom, and when it will arrive. They must accept it. If they refuse or charge a handling fee, that is a violation and can be reported to the FTC.

Frequently asked

Is it legal to buy a casket online?

Yes. Under the FTC Funeral Rule (16 CFR Part 453), any US funeral home must accept a casket purchased from any source and cannot charge you a handling fee for doing so.

Will the funeral home give me a hard time if I bring my own casket?

Legally they cannot refuse or add a surcharge. Many funeral homes accept outside caskets routinely. If a funeral home resists, remind them of the FTC Funeral Rule or choose a different funeral home.
